What is a Work Permit?
A work permit is an official document issued by the Ministry of Labor and Social Security (MLSS) that grants foreigners legal permission to work and reside in Turkey. Foreigners who do not qualify for a work permit exemption must obtain one to be legally employed in the country.
Work Permits for Foreign Athletes and Coaches
The International Labor Force Law (Law No. 6735), which regulates work permits and exemptions for foreigners, became effective on August 13, 2016. One significant change introduced by this law is the removal of work permit exemptions that were previously available to foreign athletes and coaches under the Foreigners' Protection Law (Law No. 4837). According to the new law, all foreign athletes, including football players and coaches, are now required to obtain a work permit to be employed in Turkey.
Who Are Considered Foreign Athletes?
Foreign athletes include professional and semi-professional players, coaches, assistant coaches, and equipment managers who come to Turkey to engage in sports activities.
How Do Foreign Athletes and Coaches Come to Turkey?
Previously, foreign athletes could work directly for a sports club in Turkey under the work permit exemption. However, the new law mandates that they must obtain a work permit. While the specific regulations regarding the scope and qualifications of these permits are still being defined, all applications for work permits must now be submitted to the MLSS. Similar to other professions, foreign athletes can apply for a work permit from within Turkey if they hold a valid residence permit for at least 6 months. If the athlete is abroad, the application must be made through the Turkish Consulates in their home country.
Application Process for Foreign Athletes and Coaches
In-country Applications
- If the foreign athlete or coach is already in Turkey with a valid residence permit, they can apply directly to the MLSS.
Out-of-country Applications
- If the foreign athlete or coach is not in Turkey, they must apply through a Turkish Consulate in their home country or country of permanent residence.
Required Documents for Work Permit Applications
From the Foreign Athlete or Coach:
- Work permit application form completed by the employer.
- Copy of valid residence permit (for in-country applications).
- Copy of passport or equivalent ID (with notarized translation if not in Latin alphabet).
- Contract with a Turkish sports club outlining the employment terms.
- Proof of qualifications or experience in the specific sport.
From the Employer:
- Application letter prepared by the employer.
- Latest Trade Registry Gazette showing the company’s capital and partnership structure.
- Tax return or financial statement approved by the tax office or certified public accountant.
