Witness Protection Measures
According to Article 5 of the Witness Protection Law, comprehensive measures are implemented to ensure the safety of witnesses and their relatives. These measures are designed to provide confidentiality and security.
Confidentiality of Identity and Address
The witness’s identity and address details are recorded and kept confidential. Additionally, a separate address is designated for any notifications directed to the witness.
Physical Security and Testimony Environment
The witness may be heard without others present in the courtroom or testify in a private setting with voice or image alteration. Protected witnesses who are detained or convicted may be placed in secure correctional facilities suitable to their needs.
Changes in Identity and Official Documents
The witness’s identity-related records, such as criminal record, military service, tax, and civil records, can be modified, and new documents issued. ID cards, driver’s licenses, passports, and other official documents may also be changed as part of protection.
Financial Assistance and Livelihood Security
Measures may be taken to allow the witness to use rights related to movable or immovable property, and temporary financial support can be provided if necessary. The witness’s workplace or educational institution may be changed for safety.
Relocation Within the Country or Abroad
For the witness’s security, relocation to another residence within the country or to another country under international agreements may be arranged. The witness’s physical appearance can be altered with or without cosmetic surgery, and identity information adjusted accordingly.
Conditions for Implementing Protective Measures
Multiple protective measures may be implemented simultaneously under the Witness Protection Law. However, if the same security level can be achieved with a less severe measure, that option is preferred.
