What is a Humanitarian Residence Permit?
The Humanitarian Residence Permit is regulated under Articles 46 and 47 of Law No. 6458 on Foreigners and International Protection. Additionally, it is outlined in Article 44 of the Regulation on the Implementation of the Law on Foreigners and International Protection.
Who Can Obtain a Humanitarian Residence Permit?
A Humanitarian Residence Permit can be issued in the following situations:
- When it serves the best interest of a child.
- When foreigners have been issued a deportation or entry ban, but their departure from Turkey is not feasible or reasonable.
- When deportation is not possible, according to Article 55 of the Law.
- When judicial proceedings are ongoing under Articles 53, 72, and 77 of the Law.
- During the process of returning the applicant to the first asylum country or a safe third country.
- When urgent reasons, national interests, public order, or public security require a foreigner to stay in Turkey but prevent them from obtaining other types of residence permits.
- In extraordinary situations, where a Humanitarian Residence Permit is necessary.
Duration of the Humanitarian Residence Permit
- Initial Permit Duration: It is valid for up to 1 year and issued by the Provincial Directorates of Migration Management.
- Renewal: It can be extended with the Ministry's approval for one-year periods.
Requirements for a Humanitarian Residence Permit
Unlike other types of residence permits, the Humanitarian Residence Permit does not require standard conditions for issuance.
Reasons for Rejection, Cancellation, or Non-Renewal of a Humanitarian Residence Permit
The permit can be canceled or not extended in the following cases:
- If the conditions leading to its issuance no longer exist, the permit can be revoked by the authorities.
- Cancellation or non-renewal requires approval from the Ministry.
Additional Information on Humanitarian Residence Permit
- Address Registration Requirement: Foreigners granted a Humanitarian Residence Permit must register their address in the Address Registration System within 20 business days from the issuance date.
- Transition to Other Residence Permits: Individuals with a Humanitarian Residence Permit can apply for other residence permits (excluding long-term residence permits) if they meet the necessary requirements during the permit period.
- Duration Calculation: The time spent under a Humanitarian Residence Permit is not considered when calculating the total residence permit duration required for other types of permits.
