Examination of Victims and Other Individuals
Examinations and sample collection from victims are conducted to gather evidence, provided they do not pose health risks and do not involve surgery. If the victim consents, no court order is necessary.
Examination of Minors and Mentally Ill Individuals
The legal guardian decides on examinations for minors or mentally ill individuals. If the guardian is a suspect or defendant, the court decides on the examination, and evidence use requires guardian approval.
Examination of Women
Women can request that their examination be conducted by a female physician. If a female physician is unavailable, a male physician may perform the examination.
Inadmissibility of Unlawful Evidence
Evidence obtained through unlawful examinations or sample collection is inadmissible in court proceedings.
